Terms and Conditions

 

The agreement is between Mega Bedding and Furniture Ltd (we, us, our) and customers of the website (you, your).

 

By placing an order on this website you agree to be bound by the terms and conditions as set out below.

 

1.       The website

We reserve the right to modify or withdraw, temporarily or permanently, this website or any part of this website without notice and that you agree that we shall not be liable to you or to any third party for any modifications of the website or its withdrawal.

2.       Photographs

Photographs of products are included on the website in order to give an idea of how each product looks. You should be aware that photographs may not give an accurate indication of dimensions; for instance, most images of beds show the double size, regardless of whether the individual product is a single, double, king size, super king or other size. 3.       Acceptance of your order

Your order may not be accepted if:

a.       We cannot obtain authorisation for your payment

b.       There is an error in pricing or description

c.       The products you have ordered are unobtainable

d.       Your address is inaccessible.

4.          Any problems with orders

If there are any problems with your order you will be contacted by us.

5.          Delivery

a.        Where “Free Delivery” is specified, there will be no charge to you over and above that which is indicated for the product(s), where the product(s) is to be delivered to a UK mainland address.

b.        You agree to accept delivery at the time agreed with us or, in the case of a manufacturer’s delivery, with the manufacturer’s delivery agents.

c.        If you fail to accept delivery at the agreed time, we reserve the right to recover any transportation costs for the return trip.

d.   It is your responsibility to ensure that there is adequate access to the premises in order to allow the goods to be delivered. We shall not be held liable if the lack of access prevents delivery of the goods.

e.    If the product(s) is to be delivered to a room of choice, there must be reasonable and sufficient access via doorways, stairways, corridors, etc. You should contact us if you require a delivery to a room more than 2 storeys in height from the entrance to the building or if there is restricted access. If you are unsure whether your property offers reasonable and sufficient access, please contact us.

 

6.          Returns and cancellations

a.        You will inspect the product(s) on delivery and inform us immediately if the product is damaged or defective in any way.

b.       If the product(s) is damaged or defective we shall either exchange the products free of charge or give you a full refund. If we agree to exchange the product(s) you will ensure that the product(s) is adequately wrapped in its original packing for return to us.

c.       If the product is not damaged or defective, you must, within seven working days of delivery, notify us if you wish to cancel your purchase. In this case, you will be offered a refund of the purchase price, but you will bear the cost of returning the product(s) to us by a recognised national carrier. The product shall be returned to us undamaged and adequately wrapped in its original packing.

d . Cancellation of an order may incur a restocking charge of up to 10% of the total price.

7.          Payment

a.       The price includes VAT at the current UK standard rate.

b.       All orders are to be paid for in full before delivery.

c.       Orders will not be processed until payment is made.

d.       All credit/debit card details are processed through a secure, encrypted site.

e.       If your credit/debit card issuer refuses authorisation of payment to us, we shall be permitted to cancel our contract with you.

8.          Failure to deliver the product(s)

We shall not be liable for non-delivery or delayed delivery by reason of (but not limited to) industrial action of any kind, fire, floods, vehicle breakdown, acts of God, delays by suppliers, or by other causes beyond our control.

9.          Agents

Any part of our contract with you may be performed by our agents or by any other person nominated by us.

 

10.      The contract

All information provided to us by you is true and accurate.

The contract shall be governed by the laws of England and subject to the jurisdiction of English courts.

 

11.      Privacy

 

a.       We shall use the information provided to us for the following purposes only:

·    Processing your orders

·    To administer this website

·    If you consent, to notify you of products or special offers that may be of interest to you.

We shall not otherwise, than for the purposes of processing your payment through a secure payment site, disclose any details to a third party.

 

b.       You agree that you do not object to us contacting you for any of the above purposes whether by telephone, e-mail or in writing and you confirm that you do not and will not consider any of the above as being a breach of any of your rights under the Privacy and Electronic Communications (EC Directive) Regulations 2003.
